I had a very difficult time gaining access to my lawyer. I primarily dealt with a paralegal, until I requested a delay in my closing. The inspection revealed that the 12 windows in the unit were inoperable. This was a major issue for me. I stated several times to my realtor and my attorney that the repair of the windows was something that I wanted the sellers to pay the cost of the repairs. My realtor mentioned she included this request in an email to my attorney. Separately, I sent an email to my attorney, copying my realtor and the transaction coordinator. I noticed my request was not included in the attorney review, I emailed my attorney (copied my realtor) asking why. I did not receive a response. Instead I got the final document which asked for my signature. When I questioned if I should sign this, I was assured by realtor that the windows were something the seller's agent said the sellers were more than willing to assist with. Against my better judgement I signed the contract. For several weeks, I sent emails to my realtor and my lawyer asking about the status of the windows, and for several weeks my emails and calls went unanswered. The week before closing I sent an email titled "Delay Closing", and it was then my real estate agent alerted me, via email, that the sellers would not be paying for the cost of the windows because it wasn't included in the attorney review or the contract. It was then that I was finally able to get in touch with my lawyer, he did not accept responsibility for the error, in fact he forwarded my email confirming it was ok to proceed. I, in-turn, forwarded him the emails I sent prior to signing (one which required placing the home into a trust, when we spoke - he had no idea what I was talking about). I explained why I signed the review, based on my realtor's assurance that the sellers were willing to help with the costs. I expressed my frustrations at not being able to reach my lawyer. He heard me and made adjustments to be more accessible. However, it was too late. Several emails were exchanged and the sellers refused to take on the cost of fixing the windows. This is now my responsibility.
